General Terms and Conditions Affinato

Scope of Application

1.1 Refined Is the manager of the e-commerce Refined, a marketplace dedicated to the sale of high quality wines (hereinafter "platform"). The following "General Terms and Conditions" govern the free use of the platform.

1.2 The Terms and Conditions can be downloaded and printed in the updated version for the duration of the agreement.

Contract

Online registration constitutes a binding proposal for the formation of a contract with Refined. Registration will be confirmed by e-mail, but the contract will not be effective until the account is activated via an activation link sent by Refined.

Description of Service

3.1 Refined offers registered users the ability to contact wine sellers through the platform.

3.2 Refined does not directly offer any wine for sale. Sales under the brand name Refined Are completed by other group companies Refined. Seller information can be found in the "Seller" section of the listing.

3.3 Listings are not a binding offer to sell, but an invitation to solicit an offer from the seller.

3.4 Any contracts are made exclusively between the seller and user, and their performance is solely the responsibility of the seller and user.

Registration, User Account and Information

4.1 Only persons of legal age may register. Minors are not allowed to register.

4.2 To register, an active e-mail address and password are required and used as login credentials.

4.3 The password is strictly personal and the user is required to inform Refined In case of suspected unauthorized use.

4.4 The account is personal and cannot be transferred to a third party without explicit consent.

4.5 You are responsible for all activities conducted through your account unless you prove that there was no negligence on your part.

Using the Platform

5.1 Registered users have free features to facilitate the use of the platform, including account management.

5.2 Refined can change the use of the platform and its functionality at any time.

5.3 Registration is free of charge.

5.4 Only users of legal age may make purchases.

General Obligations of the User

6.1 The user must refrain from any activity that may impair the operation of the platform or overload its technical infrastructure.

6.2 The search for commercial offers is allowed only through the search forms provided by Refined. The use of automated software to access platform data is prohibited.

6.3 Data obtained through the platform cannot be used to create personal databases or for commercial purposes.

6.4 It is prohibited to use the platform to send messages with unauthorized advertising content.

6.5 Users must promptly report any malfunctions or illegal content.

Reporting Sales

7.1 The user is aware that Refined Charges a transaction fee on sales completed through the platform.

7.2 The user must report to Refined all sales concluded through the platform, indicating the purchase price and the name of the seller.

7.3 In case of failure to report, the user shall pay a transaction fee equal to 5% of the total price.

Contract Duration, Termination, Blocking

8.1 The contract is for an indefinite period and may be terminated with immediate effect at any time.

8.2 Refined reserves the right to block access to the account in case of repeated violation of contractual obligations.

Warranties and Liabilities

9.1 Refined is committed to ensuring the proper functioning of the platform, while recognizing that continuous and uninterrupted access is not technically guaranteeable.

9.2 Refined is not responsible for the content and commercial offers posted on the platform, as they are not subject to prior verification.

9.3 Liability for indirect and consequential damages is excluded to the extent permitted by law.

Data Protection

Data protection is governed by the Privacy Policy of Refined.

Final Clauses

12.1 If one of the contractual provisions is deemed invalid, this does not affect the validity of the other provisions.

12.2 The applicable law is that of the Italian Republic.

12.3 Refined reserves the right to change these general terms and conditions.
